Refund Contracts shown are either available now or expected to be finalized by the Water Company in the near future and become available to purchase.
When Refund Contracts are finalized, estimated balances, payments and remaining term shown will be adjusted to reflect the final audited costs.
All Refund Contracts are subject to prior sale.
Direct Investment
Investors considering the direct purchase of one or more Refund Contracts may contact us and request additional information. We will provide an investment summary sheet, executive summary, financial information of the prospective water company, and answer any questions.
Fund Investment
Investors considering an investment in the Fund may request the Offering Documents which includes the Private Placement Memorandum, Form of Note, and the Subscription Agreement. Investment is limited to Accredited Investors.
How Refund Contracts Are Originated
Refundable Deposit Contracts ("Refund Contracts") are direct payment obligations of the largest Water Companies operating in California.
- Refund Contracts are created when real estate developers build projects that require the extension of water mains and related water infrastructure.
- The Real Estate Developer pay the Water Company the entire cost to extend water services to their project. The monies paid are treated as a Refundable Deposit.
- The Water Company constructs the new water system to serve the developers project.
- The Water Company owns the new water system.
- The Water Company refunds the Developers cost over time by making annual payments under the Refund Contract.
Real Estate Developers sell their Refund Contracts because they are not in the business of owning long term Refund Contracts, and they make better profits using the money from selling the Refund Contracts towards building new projects.
Apex Income Fund buys Refund Contracts at a price that earns a 9.0% yield. The income from the Refund Contracts are passed through and paid to the investor as payment on their Investment Notes.
